Regarding the VIX, how do you count what we had in fall 98? It went above 40, then back down (but now below the 200 MA) and then made a second higher high 1.5 months later.


First, that was in a bull market. Second, it eventually played out as I've described only later (after a "double dip")----> peak to peak was 5 weeks. Finally, if you had bought at the first peak and held until it did move down below the 200 day MA, you would have made a very profitable trade. That is true for each occurance of the VIX moving above 40 over the past 5 years.
