Actual applications are better in that they are more transparent. However, even with applications the person performing the benchmarking must be aware that some tasks (or test files) may show disproportionate results. I think some of the graphics editing tests show this - same app different file and/or operations shows big Athlon or P4 lead.

With MP3 encoding some programs also strongly favor one platform or the other.

So the selection of applications should be diverse to provide values which are useful to the readers. While some types of software may be interchangeable (ie. user would select the faster MP3 encoder) others are not (AutoCAD) and may be a significant element of deciding which platform is more appropriate for an intended system.

I don't think it's illegal to chose biased benchmark subroutines even if you are an "independent" benchmark developer.

Ehhh.. and who cares anyway in the grand scheme of things? Intel lies and cheats, AMD lies but doesn't have the resources to cheat... they're big corporations and unless they're blatant, they can get away with a lot.
