Ashcroft asserted a position in OR which was not upheld nobody's rights were infringed.....

The TIPS program is a proposal(one I oppose BTW) which is still being debated....

He is asserting a position in CA which may or may not be upheld.

So the question remains:

What parts of the Constitution and Bill of Rights have been suspended? Be specific.
