Yes, and therefore I would expect the judgment in your favor would be a half step higher. If I were Varian, I'd say: "OK, that's enough. This lawsuit has become a scorched earth affair and isn't doing either of us any good. We'll agree to forget about the damage award, drop the lawsuit, and give you $X towards reclaiming your life. You, in turn, agree not to sue us. We know we can't force you not to continue to write messages about us, so we'll just ask you for some voluntary restraint." I mean, from a monetary as well as emotional standpoint, this has got to be a better alternative than continuing the fight. - Jeff
