Well it is a bit over simplified but I think you are on the right track. We in fact don't let murderers walk. However, the expense and resources allocated to their handling results in some rather dire consequenses for society. Our courts are clogged. DAs are directed to plea bargain every case beneath murder and many criminals walk through a revolving courthouse door as a result. Most criminal cases just aren't considered "important" enough to deal with.
