I don't think that's a fair call. I believe the only reason Lindh, who was caught fighting with the enemy against the US hasn't been convicted is his attorneys are good. Patty Hearst wasn't treated a fraction so fairly. Padilla hasn't been accorded the same treatment as Lindh, imo,though he may well be guilty of treason. Here's what the Constitution says about treason.

Section 3. Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court.
