Iraq vote necessary

White House lawyers apparently told President Bush earlier this month that he, in fact, does not need congressional approval to attack Saddam Hussein and Iraq.

That's the word from two senior administration officials who said that White House counsel Al Gonzales told Bush that the Constitution gives the president authority to wage war without explicit authority from Congress. That's no doubt because the Constitution designates the president as commander-in-chief.

Gonzales also told the president he had authority to act under the 1991 Persian Gulf resolution that approved the use of military force against Iraq. It allowed the use of force to enforce U.N. Security Council resolutions, including demands that Iraq get rid of weapons of mass destruction and allow U.N. inspectors into the country - which it has not done. But when Iraq formalized a cease-fire with a notification to the U.N. Security Council, that authority technically ended. And if neither of those scenarios flies, administration officials are also pushing the case that the Sept. 14 resolution endorsing a military response to the terrorist attacks on the World Trade Center and the Pentagon fills the bill. That assumes there is a link between Iraq and al-Qaida, which is disputed and as yet unproven.

While all three options offer some justification for Bush being the sole decision-maker, they miss the real issue here. As Harold Hongju Koh, a professor of international law at Yale Law School, noted, it's shortsighted for the administration to try to avoid a full congressional debate about such an expensive and perilous operation.

"The constitutional structure tries to make war hard to get into, so the president has to show leadership and make his case to the elected representatives," said Koh, who was an assistant secretary of state in the Clinton administration. He pointed out that the constitutional argument may permit the administration "to get us into the war, but it won't give them the political support at home and abroad to sustain that effort."

There are already questions being raised at home - many by high-ranking Republicans. But the criticism at home is mild compared to what's coming from abroad.

Gerald Kaufman, highly respected former foreign affairs spokesman of the ruling Labor Party in Britain - this nation's closest ally - minced no works last week when he verbally skewered our nation's president and his advisers, suggesting President Bush and his team have no concept of the dangers that an invasion of Iraq poses, not only to the stability of the Middle East but also the world economy. We quote:

"Bush, himself the most intellectually backward American president of my political lifetime, is surrounded by advisers whose bellicosity is exceeded only by their political, military and diplomatic illiteracy."

In the face of such heated criticism, White House press secretary Ari Fleischer keeps trying to reassure citizens and politicians that Bush is listening to many views but has not yet decided how to proceed against Iraq.

"The president welcomes thoughtful opinions. He views this as part of the healthy national debate on the threat posed to peace by Saddam Hussein and his weapons of mass destruction," Fleischer said Sunday. "He always welcomes any support for decisions he has not yet made."

When Fleischer makes statements like those, it's no wonder the Brits are going ballistic. We should be, too.

So President Bush welcomes "any support." He does not yet have ours or that of any thoughtful citizen. He will not get that support unless he asks for it and is able to make his case.

Bush needs more than a lawyer giving him the OK to lead this nation into war with Iraq. He needs the OK of American citizens via their elected representatives in Congress.

After Saddam Hussein: Then what?

As much as nations despise Iraq's villainous president, many fear a U.S. attack to get rid of him would do more harm than good - in Iraq, to its nervous neighbors, and beyond.

History is full of designated villains - from the German Kaiser Wilhelm of World War I to Tojo and Hitler of World War II to Khruschev and Fidel and Mao of the Cold War. In the war on terrorism, there was Col. Muammar el Kadafi, the Libyan leader a few years ago and more recently Osama bin Laden. And now, again, comes Saddam Hussein, the Iraqi leader whose ouster is demanded by the Bush administration ... or else.

Hussein deserves the tag. He has used poison gas on his citizens and is known for the bloody ruthlessness with which he deals with potential rivals for control of the apparatus of state. He sent thousands to slaughter during an eight-year war with his neighbor Iran and has shown contempt for international law.

Hussein played the role of villain a decade ago in the first Gulf War, and many think that was a more convincing portrayal: After all, he had just invaded a neighboring country, Kuwait. What he is up to now is a matter of conjecture - perhaps he has weapons of mass destruction, perhaps he has aided terrorists - but he is portrayed as such a villain that even such possibilities are used as a justification for possible warfare.

"It's not a new technique in war propaganda," says Rashid Khalidi, a Middle East expert at the University of Chicago, of the personal demonization process. "There was Tojo and the Kaiser, you can go back to Jeff Davis. It's not just us that does it, everybody does."

The presumption behind the process is that if the villain is removed - cut out like a cancerous tumor - the body politic will return to full health. This doesn't always work because sometimes the villain is only the public representative of a much deeper societal sickness.

The problem with the current proposed villainectomy is that no one is exactly sure if the patient - or the entire hospital, for that matter - can survive the operation.

Start with Iraq, which as ancient Mesopotamia was the cradle of Western civilization, home to the Tigris and Euphrates rivers that nourished some of the earliest cultures known to history or archaeology. Its modern version was created by British cartographers, dividing up colonial spoils of the Middle East after World War I. Its throne was handed to King Faisal, a Hashemite from Saudi Arabia and a British ally in that war.

Ethnically, the country made little sense with Kurds in the north, Sunni Muslims in the middle and Shia Muslims to the south. But few colonial-era boundaries made much sense.

It was in 1958 that the Sunni-based Baathists - Arab socialists - came to power in a bloody coup that wiped out the Hashemite royalty, though one branch of the family still controls Jordan.

Hussein is the Baathist strongman who holds the disparate elements of his country together through sheer power, much as Tito did Yugoslavia, although far more ruthlessly. If he disappears, what would happen to the country?

"Iraq has become more stable as it has become more authoritarian," says Waleed Havbun, an assistant professor of political science at the Johns Hopkins University. "The question is, if that authority is removed, what's going to keep Iraq together? There's no easy answer to that."

Khalidi says that is particularly worrisome to Iraq's neighbors. In Iran, he says, there would be pressure to aid their ethnic brethren, the Shia, which the Iranian government does not particularly want to do. Turkey would fear renewed difficulty with its population of Kurds should those in Iraq, freed from Hussein, reignite the quest for their own nation.

"What is going to prevent the situation from becoming a vortex or a vacuum, either of which has the possibility of bringing in the two powers next to Iraq, both of which are terrified of the prospect of the collapse of that regime," Khalidi says.

He argues that Iran's leaders would be trapped if there were chaos in Iraq: They would face pressure from within to go help the Shia population, but would fear that action would anger the Sunni-dominated Arab states.

In Turkey, Khalidi says, the military - historically the power behind the elected government - would probably assert itself to thwart any move by the Kurds.

"It doesn't make sense to try to bring democracy to 20 million Iraqis while you lose democracy for 60 million Turks," he says.

Add the potential for severe pressure put on governments in Jordan and Syria to react against a U.S. invasion of Iraq and many observers fear that removing Hussein might come with a big regional price tag.

It is a price that those arguing in favor of military action are willing to risk paying because, they say, the alternative is having weapons of mass destruction - biological, chemical, nuclear - in the hands of a madman.

But not all are convinced he has those weapons. Lou Cantori, a political scientist at the University of Maryland, Baltimore County, doesn't think so.

"What we have is a lot of rhetoric and talk, but little in the way of substantive content as far as a genuine threat is concerned," he says. "This is an undesirable, reprehensible regime whose significance is nearly entirely limited to Iraq itself."

Still, those arguing for action say it would be justified by bringing freedom to citizens.

Havbun says the best possible scenario if Hussein is eliminated is the emergence of a federal system, a unified country with much power in the hands of the three basic regions.

But instilling the type of democratic principles needed to support such a system is not going to be easy.

"The goal of regime change that the Bush administration enunciated is practically speaking the equivalent of the demand of unconditional surrender issued to the Axis powers during World War II," says William Galston, director of the Institute for Philosophy and Public Policy at the University of Maryland, College Park. "In demanding and then receiving unconditional surrender, we assumed comprehensive responsibility for the political, economic and social reconstruction of the countries occupied."

Galston says that unless the United States is willing to make a similar, perhaps decade-long commitment to Iraq, it will be hard to expect any sort of democracy to bloom in that oil-soaked desert.

"In Germany and Japan, we undertook over a period of many years of occupation to purge those societies and political cultures of the elements thought responsible for the bad regimes that precipitated the war," says Galston. "It was a long and difficult venture and the same will be the case in Iraq."

A task made even more difficult, Galston says, by the realities of the region which would probably view any long-term occupation by the United States "through the prism of the colonial experience."

John Steinbruner, head of the Center for International Security Studies at the University of Maryland, says the real victim of a strike against Iraq without definitive proof of weapons of mass destruction would be the United States' standing in the eyes of the world.

"We are making ourselves the judge, jury and prosecutor and we are not allowing any defense attorney on the scene," he says. "Obviously, the world cannot tolerate one country's right to eliminate by force any government it does not like. That's not a world we can live in. We supposedly stand for the rule of law. We need to apply it to ourselves."

Scott Ritter, who resigned from the United Nations team inspecting Iraqi weapons in 1998 to protest political interference, says if the Bush administration were serious about making sure Hussein does not have these dangerous weapons, it would put getting weapons inspectors back in Iraq at the top of its agenda, not regime change.

He argues that if those inspectors went in and found such weapons, military action would be inevitable, but then it would come with the backing of European allies and other members of the original gulf war coalition.

But if they were not found, then Iraq could be welcomed back into the community of nations, its oil could flow, its wealth could grow, a middle class could emerge, and the country could evolve toward a day when Hussein is not in power and democracy would be possible.

Privately, he says, members of Congress and other officials agree with his assessment, but few will speak out publicly. He blames the demonization of Hussein.

"Who wants to come out in favor of diplomatic engagement with the devil?" Ritter says. "This guy has become the Middle Eastern equivalent of Adolf Hitler."
