Not exactly what we mean by "having a lawyer." She's doing a pretty good job for him, except that I think she screwed up by filing the petition for habeas corpus in New York, rather than in South Carolina. Justice Dept. argues that she needs to serve process on Padilla's custodian, and the custodian is in South Carolina with no contacts with New York. That seems correct to me. news.findlaw.com I guess she was hoping to get a more liberal court than she'll find in South Carolina.
