Greenpeace plans legal action vs UK govt on £410 million aid to British Energy

Environmental activist group Greenpeace is planning to take legal action against the government over its decision to provide £410 million of aid to ailing nuclear generator British Energy PLC.

In a letter to Trade and Industry Secretary Patricia Hewitt, Greenpeace said the cash bail-out was a "flagrant breach of the law governing state aid" as it was done without the consent of the European Commission.

It demanded that the money be repaid to UK taxpayers immediately.

"The loan was made without pre-notification and without receiving approval from the European Commission despite there being a legal requirement to do so. This means that the loan was illegal and must be repaid and that other power generators which may have suffered commercial damage can make legal claims for compensation as a result of lost profits," the organisation said.

"If the government refuses to withdraw the loan, Greenpeace may launch a formal legal challenge in the High Court," it warned.

Greenpeace urged the government to close down British Energy's nuclear power stations and focus on safer alternative renewable sources of energy.
