Merrill pled guilty to Spitzer, coming clean now
mgmt doesnt want any more dirty laundry lying around
maybe the two guys were sacraficed
maybe they have the most personal culpability
Merrill clearly doesnt want any new charges against their firm

Merrill will have to reinstate the execs because it cannot fire them for exercising a constitutional right. Nowhere in their contract does it say that they have to surrender their basic rights to work for Merrill.
