That is not a true statement. You assume, that the stock will go up. Now in Elan's case that is probable but by no means a lock. WCOM comes to mind.

When a company goes to zero, the shorts do not have to buy back shares. 1 out 6 Elan shares are currently short. The shorts feel very confident that Elan will not survive or will at least end up on pink sheets.
