ummm...come again? Are you saying that if the SC rules that the NJ Dems cannot substitute a Senatorial candidate it's because it is bought and paid for by the Repubs? The ONLY reason?

No, I'm saying that will be the perception. And remember my full scenario. The NJ Supreme Court, with a preponderance of its positions appointed by Dem governors, decides for the Dems; the Federal Supreme Court, with a preponderance, to put it mildly, of appointees by Rep presidents, decides for the Reps. Taken against the backdrop of the Bush Gore 2000 decisions, folks are much quicker to reach a conclusion that courts are simply extensions of political parties and thus can't arbitrate.
