The SEC granted Sky's registration in August, 2001. Earlier this month, the NASD denied the membership application, which was appealed by Sky and a hearing on the appeal was scheduled for early April. Today, after extensive discussions with the staff of the NASD, an agreement in principle outlining the basis upon which the membership application would be granted. In connection with that agreement, the hearing was adjourned to May 16, 2002.Based on the agreement in principle, Sky expects that its membership agreement in the NASD should be signed in early May and that it will commence active broker-dealer operations shortly thereafter.
