"The jury decided this case based on the facts, and the facts did not entitle this plaintiff to recover damages because she may have been exposed to ETS on airplanes," said William S. Ohlemeyer, Philip Morris Companies vice president and associate general counsel. The six-person Dade County jury deliberated approximately two hours following the one-week trial before deciding that Julia Tucker, a 45-year-old flight attendant for US Airways, was not entitled to recover money damages for her chronic sinusitis. Today's verdict came in the fifth flight attendant case to come to trial, and was the third verdict in favor of Philip Morris U.S.A. and other cigarette makers. One case ended in mistrial; two resulted in defense verdicts; and one resulted in a plaintiff's verdict, which is being appealed. Ms. Tucker had sought compensatory damages; a previous agreement prevents the flight attendants from pursuing punitive damages.
