No equal protection argument. The Republican brief is not even making an equal protection argument. They are making a "due process" argument which was only supported by the Rehnquist 3 in Bush v. Gore. They need a 4th judge to get a grant of Certiorari.

Has any link been posted to the actual law?? I think you summed it and I'd guess the SC would vote as you suggest. But as you say, what will be will and I'll not complain, whine, snivel like our lefty loony toon posters.
