It's always been that way, it always will be that way. Supreme courts interpret law de novo. That's what they are for.

Looks to me as if we'll just have to agree to disagree. I view the Gore-Bush stuff as embarrassing to the court, inherently political (not just political in the way the court is always just a bit), as contradicting their own past views (thus, enhancing the political character of the decision), and, finally, as having confessed to that by putting in that wonderful little aside that we should not take this all too seriously, after all it should not be treated as precedent.

You've clearly got a different view. There's a cliche in here somewhere about what it takes to make a conversation.
