Yes, exceptional situations like Pearl Harbor and 9/11 are so clear cut there is no need for splitting constitutional hairs.

But what is not so clearcut are some of the initiatives by this administration that have been discussed here. Some of these are attempts to shift the balance of power toward the executive branch and I don't particularly like that. But probably a good deal is just normal incompetence, the mania for "reorganizing" to look and feel busy that Andy Grove talked about in his book "Only The Paranoid Survive". We've seen the wonderful efficiency of our airline security changes - what the Israelis sarcastically call "A system for bothering people".

There's certainly no shortage of the stuff conspiracy theories are made up of in this Iraq, Patriot Act and other terrorist business going on now.
