No, we do not have a perfect system of assessing intent. But we cannot treat malicious or negligent behavior as "just an accident", where the responsibility is limited to who has to clean the mess. No one thinks that is justice, especially after a brutal murder or other very serious crime. People renounce the right of private vendetta with the understanding that the state will bring the perpetrator to justice. If the results are too unsatisfactory, people will once again take matters into their own hands, to the general detriment of society.......
