Excellent link. The key there is "sudden and unexpected civil disturbance", with exception however "has rarely been used", and rightfully so, since it's under the same category as "insurrection" ! It looks like what has been invoked is the (10 USC 371-380) exception for "Loan of equipment, training and operation", which they've construed as the surveillance planes and operators as "equipment", providing information to local law enforcement under drug and immigration laws. Sketchy. Otherwise if it's (10 USC 331-333) this specifically requires presidential proclamation, according to the document.
