part 3 by furnitureman Outlined below are comments I heard REK make at the "scrum". Some others may have heard some or all of these and can perhaps verify. There is no particular order, just what I've remembered and what I could make notes on. At the beginning she was asked by 2 or 3 people why no Q&A from the floor during the meeting. People said that it was not appropriate for a public company to restrict questions to a "scrum". She repeated her previous answers and refused repeated requests to use a microphone so that more than 6 people could hear what she said. At one point, I would estimate that there were 30-40 people crowding around her; the people in the back basically couldn't hear the questions being asked or REK's answers. She did say that the transcript of the scripted Q&A will be put up on the web site. Hopefully this is one promise that does come to fruition... Anyway, on to the words uttered by REK. Some are "direct quotes", others are paraphrased: * "I've spent quite a lot of the time in the US recently" * "FDA plant inspection was for Pennsaid; not for Dioptic or contract manufacturing." When asked why a NR was not issued she said that it would be breaching regulations. When asked why a President's Message was OK with the regulators but not a NR she said that there is a grey area and the NR steps too far into it. * "FDA submission is complete....Nothing else is required at the moment" * "I expect HC to approve before FDA" * Some discussions are taking place about US labelling * Marketing Study in Canada (oral NSAIDS vs Pennsaid) was "completed at the end of Sept". "We're confident of the results" i.e that they will continue to show effigacy and safety. DMX wants results published in a journal of some kind, and to ensure that a journal will publish the results she will not pre-release before that. * "The Bloc Quebecois have been very helpful in putting pressure on HC." (Varennes is in their riding.) DMX is no longer just an application i.e. HC knows that politicians have been asking questions * "Standstill is still in effect" * "Everyone is entitled to a private life" (in response to repeated attempts to quiz her about the share "sale") * She would be "happy" if they could get a 3 year patent extension in US and Europe. Most they could get would be 5. * REK sees no comparable competition on the horizon * "Acqua believes in DMX" (REK made some reference to Acqua not selling any shares between Jan and Oct 2001....anyone else catch this? Also what did REK say when asked if Acqua shorted?) * REK seemed to say the Acqua still holds 1.5M shares. I didn't really hear this clearly.....it seems wacky, but maybe somebody heard it more clearly? * She almost said what unit Italian distributor was expecting to sell, but she caught herself and didn't finish the sentence - - - - - - - - - - - - I am sure there will be other people who will fill in other things they heard at the scrum.
