I am certain that there is a presumption that they are terrorists, based on evidence, and that the men are being interviewed, including by diplomats from their own countries, and, when it turns out that they are not terrorists, they are being released.

Being a member of, or a supporter of, Al Qaeda, or any other terrorist organization which commits terrorist acts against the United States is a violation of US law.

The Geneva Convention does not require us to accord POW status to criminals who violate US law.
