...Microsoft attorney David Tulchin said there is "huge risk in importing the findings" from the government case "into five cases with millions or billions of dollars at stake" in potential damages.

..."Judge Jackson's conduct alone" makes using those facts inappropriate, Mr. Tulchin said.

But Judge Motz said he wouldn't consider Jackson's conduct. The Appeals Court reviewed that matter "with painstaking care" and found there was no actual prejudice, Judge Motz said.

He indicated he would be willing to comb through Judge Jackson's 412 findings to include only those that support the ruling by the Appeals Court that Microsoft illegally maintained its monopoly its Windows computer operating system has on the market. Also, he would consider placing those findings in context for future jurors.

..."Judge Jackson found that Microsoft did some pretty bad things," Judge Motz said. "It's not nice to go out and coerce Intel" Corp. (INTC).

Judge Jackson found that Microsoft strong-armed Intel into dropping plans to develop a chip based around running Sun's Java program, seen as a threat to Windows.
