This mugger walks into a courtroom, the Honorable James Bower presiding. Judge Bower asks the defendant, "Did you beat this man up and steal his money?"

The defendant stands up, with the pride befitting a man speaking his convictions, and proclaims, "Yer honor, maybe mugging is against the law. But it shouldn't be illegal to be the one who ends up with the money."

Judge Bower bangs his gavel, and says, "Case dismissed. Success is innocence."

I'm not trying to equate the two beyond both being violations of established law to which a similar defense has been advocated.

Ha ha, yah, right, just like the equations that that incompetent senile old fart of a judge Jackson postulated regarding Gates.

Perhaps you'd like to respond with that as a stipulation.

I stipulate nothing. I offered an opinion as to how I thought MSFT should have reacted to the whole anti-trust jihad and posted an article written by someone who expressed an opinion similar to my own.
