the American proposition of living under the rule of law

That sounds impressive; what is it? Police make decisions every day on who to arrest or not arrest. You get a warning for speeding or a ticket. If you're in Baltimore and caught with crack...if you're black you're arrested, if you're white you're sent on your way. [From the Baltimore Sun as I recall]. There are communities in Utah where polygamy is practiced; it's known by the local authorities and they look the other way. Is there a reason to believe that hookers and johns are arrested equally? There was a series in the Washington Post on the Prince George's County Police...policy brutality, and either the highest or near highest rate of fatalities against the citizenry in the country. The shooting of unarmed citizens. Prosecutions. No. Not even noted in police officers record.

Prosecutors pick and choose who they prosecute, 90% of criminal cases are negotiated prior to trial; lesser crimes, lesser punishments. Immunity deals. I think it's well known that getting an arrest on a police officer for spousal abuse falls into the category of rare.

The use of illegal drugs by blacks and whites on a per capita basis is within a few percentage points of each other. Yet the incarceration rate for blacks is several multiples higher than for whites. A similar situation exists for death row.

What is the rule of law in America?
