Without the QCOM patents, it will take them 16 years to design a trasmitter power control, soft handoff, etc. Thay can always try to bypass QCOM patents, but it takes time. How long did it take QCOM to work out those issues? Does anybody think the Chinese can do better than QCOM? QCOM patents are not based on the CDMA air interface itself. That patent belonged to Hedi Lamarr, and has expired decades ago. All the fantastic techniques necessary to build a cellular voice/data network with that CDMA air interface is where QCOM patents lie.

But the catch is, if you try to do bypass QCOM patents, you must be able to bypass all of them. because QCO only grants licences only as a package. You must buy all of them, or none of them, and build all from scratch.
