Then why would NEC need to sign a license agreement?

QUALCOMM Inc. announced that it has signed a license agreement for Application Specific Integrated Circuits (ASICs) with NEC Corporation. QUALCOMM has granted NEC a worldwide license under QUALCOMM's CDMA patent portfolio to develop, manufacture and sell third-generation (3G) WCDMA and TD-SCDMA ASICs products. Under the terms of the agreement, NEC will pay QUALCOMM an up-front license fee and ongoing royalties as NEC begins selling WCDMA or TD-SCDMA ASICs.

SAN DIEGO -- February 22, 2001 -- QUALCOMM Incorporated (Nasdaq: QCOM), pioneer and world leader of Code Division Multiple Access (CDMA) digital wireless technology, today announced an amendment to eAnywhere Telecom Inc.''s existing CDMA subscriber unit license agreement which expands the licenses under QUALCOMM''s CDMA patent portfolio to include the development, manufacture and sale of subscriber equipment for WCDMA and TD-SCDMA products. Prior to the amendment, eAnywhere Telecom''s CDMA license covered only cdmaOne™, cdma2000 and cdma2000 1xEV applications. Under the terms of the amendment, eAnywhere Telecom will pay QUALCOMM a license fee and ongoing royalties at the same rates irrespective of the licensed CDMA standard.
