There would have to be a good reason. I agree it might be difficult to prosecute. Certainly, though, one is not (for instance) allowed to make obscene phone calls simply because the receiving party had a remedy of unplugging the phone, and doing without something he/she had paid for. That is why peer judgement is so often much better than silly litigation. After all, peer assessment and judgement have been around since long before there were lawyers...
