Well, the theory is that you've already paid the price of the first two crimes, so if you're re-punishing for them it's double jeopardy. Like if you borrow three times from a bank you shouldn't have to repay the first two loans again as a condition of getting the third. Not a good analogy, of course, but that's the general idea behind the objections.
