You misunderstand. I maintain that it is the job of a judge to apply the law. Novel circumstances sometimes require the use of extrapolative reasoning, but one should still be tethered to the law. Sometimes, to clarify the intent of a statute, the legislative record is useful. But the main thing is that there is an amendment process, and it should be used for major changes in the Constitution, not relying on tenuous extrapolations from the text that amount to legislating from the bench.......
