Developers Cooperate to Reduce 3G Patent Fees

(06/11/2002, BWCS Staff) A number of leading lights from the mobile industry have joined together to introduce a new licensing arrangement to cover essential 3G mobile technology patents. NTT DoCoMo, Ericsson, Nokia and Siemens say they have reached a mutual understanding to set licensing fees for wideband CDMA 3G equipment which are proportional to the number of essential patents held by each company. The companies want to create a fair and reasonable means of determining 3G royalty payments.

DoCoMo, Ericsson, Nokia and Siemens say that together they own the majority of patents relating to W-CDMA technology, which has so far been chosen as the next-generation standard by more than 100 mobile operators worldwide. Several other equipment manufacturers which hold essential 3G patents are interested in joining the scheme, including Fujitsu, Matsushita/Panasonic, Mitsubishi Electric, NEC and Sony.

Torbjorn Nilsson, senior vice president of marketing and strategic business development at Ericsson, says: “W-CDMA is the standard selected by most operators in the world for their future business, and with this initiative we believe the cumulative royalty will be even lower for W-CDMA than GSM, which has enjoyed unrivalled success compared to any other standard in the world.”

There are certainly the players - with some, but proportionally less essential IP - who should be attracted to favorable cross-licensing terms of a patent pool. They want to manufacture.
