This is the first time I come across this type of generic threat in one of my investments, so things are not entirely clear to me. Having said that it seems from the excerpt I posted, that Elan will enjoy at least a 30 month "grace" period while things are sorted out. After that the possibility remains that the patent will actually hold.

30 months is actually much better than what I had hoped for. I was afraid that we might face a Zanaflex-like situation where the market would be lost from one month to another.

A 30 months grace window (if I have read this thing correctly) will provide Elan with much needed income over the critical restructuring period. It should give management time to sort out both the income and cost sides (I hope).
