This is not consistently applied. My Samsung A500 from sprint has the "Digital by QCOM" sticker, and, as you say, it, along with the N400, are certainly CDMA2000 products.

But that's really splitting hairs as far as the consumer is concerned. What matters is the services that the "3G" technology enables, compared with 2G. So far, the main differentiator seems to be that it takes 5 seconds to download a midi ringtone, where it used to take 20s.
