Verizon's lawsuit, filed in June 2001, alleged that Covad had purposely submitted trouble tickets for problems it allegedly knew were not Verizon's fault. Covad moved for summary judgment on all of Verizon's claims. Judge Jeremy Fogel agreed with Covad and issued a ruling dismissing all of Verizon's claims with prejudice. It is not known whether Verizon will appeal the decision. "This is a significant victory for Covad," said Charlie Hoffman, Covad CEO and president. "We denied Verizon's claims and are pleased we will no longer be burdened with the distraction and expense of this litigation. More importantly, we can continue to focus on delivering broadband services to our customers."
