They do not have the right to publish whatever they find in the e- mails

Sure they do, if they want to and are willing to take the flak. There's nothing illegal about IBM putting out a database of every email sent over their corporate network since they first set up email. It would be pretty dumb, for a whole lot of reasons, but it wouldn't be illegal.
