That very limited example of an act the private nature of which is a social taboo and has no relevance whatsoever to their business interests may carve out a small exception, though even then I wouldn't guarantee that you would have a recourse at law. There have been cases upheld where companies videotaped workers using the commode. There was a legitimate interest in determining whether they were using those private places to use drugs. As to publishing them, you would have to argue that your privacy overcame their ownership rights. And in that particular example, you might win. Or might not.

But that you had to go so far to fiind an example to draw on proves the validity of the point.
