Xybernaut Granted Second Way Point Patent

Extends Intellectual Property for Next Generation Computing/Communications Architecture

FAIRFAX, Va.--(BUSINESS WIRE)--Dec. 3, 2002--Xybernaut Corporation (NASDAQ:XYBR - News) today announced an additional U.S. patent grant related to the Company's previously announced (August 14, 2002) Way Point patent.

Xybernaut Way Point intellectual property covers methods and technologies for directing messages or information to specific (coordinate) locations. The information, which could be personalized for individuals or organizations, covers all types of information, including voice messages, audio, video, animation, Web sites, documents, text or e-mail.

"We intend to see this technology move aggressively into the marketplace. Towards that end, we have begun an active licensing campaign and are already in discussions with a number of domestic and foreign-based corporations," said Edward G. Newman, chairman, president and CEO of Xybernaut Corporation.

While the prior patent (U.S. 6,377,793) described the specification of Way Point by information suppliers utilizing latitude, longitude and radius, this additional patent (U.S. 6,480,713) describes the ability of subscribers to act upon the data, and the device's ability to store and utilize a coordinate location even when the subscriber is not in that coordinate location.

Under the parameters of the patented Way Point architecture, information could be left virtually "floating" in the air anywhere in the world, available to: 1) all subscriber recipients who happen to enter the Way Point radius as set by the information provider; and/or 2) subscribers who have a profile that makes them eligible and/or desirous of receiving that information.

"Each Way Point subscriber would have a location-determining device activated in the Way Point network. As they pass through the network, these devices will determine if subscribers have messages awaiting them. The subscribers can then access those messages, review them and execute transactions of all kinds with information suppliers. In essence, Way Point allows an individual or an organization to market to a population of one or a population of millions," added Newman.

If a subscriber's particular profile does not "match" the class of messages hanging "in the air" at his or her location, then the information is simply not made available to the subscriber. Thus, two subscribers riding in the same car will be exposed to different sets of information, messages and/or offerings as they ride along an interstate, a city grid, or in the middle of a desert.

The patents are also indifferent to the physical or logical communications or computing means used to deliver or process information and/or transactions.

The patents are directly applicable to ISPs, ASPs, on-line advertisers, telecommunications companies of all kinds -- local, nationwide or worldwide -- and various other large or small enterprises interested in making their information available to specific subsets of consumers.

Since Way Point is device-independent, it will work with any device; this includes GPS-enabled or other location-determining devices that can communicate and/or retrieve data over various types of communications networks.

Way Point covers a wide variety of potential business and consumer applications. Examples of enterprise applications would be direct marketing; one-to-one marketing; field force automation; asset management and electronic commerce.

Consumer applications include emergency response; locating a missing person; notifying drivers of dangers before they approach an accident scene or road hazard; notifying consumers of discounts near a retail outlet; or notifying a traveler of the location of a favorite type of restaurant.

The Way Point architecture is as applicable to field forces of large corporations who need technical information at a specific location and now need not carry it with them, as it is to consumers who want to utilize their cell phones, wearable computers or car GPS screens to "see" the location and services/offerings of their favorite restaurants or hotel chains as they move around.
