that shooting your rifle in the air to celebrate New Years and killing someone is an accident. Or getting into a car absolutely ripped and running down someone - that's an accident.

Neither of those would be considered murder. Under ordinary circumstances they might resul in a manslaughter charge but thats for reckless actions that result in someone's death not for intentional murder. I don't think the American pilots were acting recklesly.

Its interesting that you mention shooting in the air in celebration. That action contributed greatly to what happened in Afghanistan. The weding party were firing guns in to the air in celebration.
