I suppose if someone had a gun to my head and I had a gun I would try to shoot them first. However, we know that the man was not in direct danger from a loaded gun. He wasn't going to be killed. Tim wouldn't have been subjected to the death penalty unless Tim broke his neck which is probably feasible given Tim's build. Of course, if there had been some freak of circumstances and the guy ended up dead Tim might have been tried for murder as it was a direct result of a violent felony - that being armed robbery. However, I do believe the shop owner had the right to defend himself given the circumstances.
