That is one possible interpretation. Another is that remedies are constantly filled with loopholes and that the best way around political maneuvers is to legislate final results, not procedures, and let those involved find procedures that will deliver results. I think that is the intent of affirmative action and/or quotas. Such approaches are common in the private sector. I think a properly engineered approach would conain sunset provisions to prevent remedy from becoming it's own problem.
