They shouldn't. But neither should they be denied employment. The assumption behind affirmative action is that there is a pool of qualified applicants from which some have been excluded solely on ethnic background. The procedure behind affirmative action is the require the results instead of methods which can be further compromised. This gets the balance back quicker and does not drag out the remedy.

My personal remedy procedure for employment discrimination would be based on an ancient Chineese administration. Applicants who were determined to be qualified (and this judgement was subject to review and protest) were then picked for a position via a lottery. This greatly reduced nepotism, favoritism, and racism.

I think the best affirmative action policy would be, the most qualified person gets the position without regard to race ,religion...etc.
