I understand what your saying, but the article describes this particular database as being one of guns seized from criminals. I think you are describing a seperate illegal database IMO, which consists of information garnered from NICS instant background checks. I asked the FFL I purchase all my guns through whether he believed with any confidence that the NICS background check information, and yellow forms were destroyed after 30 days as required by law. He said that absolutely no gun serial numbers or gun descriptions go to the NICS system. The yellow forms are maintained by the FFL for trace checks. However, FBI/BATF/NICS of course knows who owns guns, their SSNs and addresses. They don't know what you have...but they know you've got something to enforce the constitution if nobody else will. I've only heard rumors that they illegally keep that information and have read nothing about court rulings or endorsements of such a database. I think the law is clear on this and if BATF or FBI is in violation, some people in high positions should go to jail for 10 years for violation of the GCA.
