IRS got some new rules, that say if the company is effectively worhtless (ussually BK) you have to report the gain on the short. I don't think Delisting is enough to trigger this, but I'm not a lawyer. Some of my best friends are lawyers, however.

One possible way around this is to short sector indexes - they will have some companies survive, thus avoiding this problem...

You can save the gain on the short for a year when you have a big deduction - like a drilling a dry hole...
