The short answer is that they'd be even worse at controlling that expensive equipment if they were asleep, as opposed to drugged, but awake.

A sleeping pilot that does not fly a plane is IMO, preferable to a sleeping pilot pretending to be awake with the aid of drugs, and flying a plane.

I guess i mis-phrased my question. If its illegal in the US to give these folks these medications, what makes it OK to give it to them outside US territory ?
