I suppose that's possible. But not probable given that the Constitution explicitly acknowledges other categories of human entities for purposes of US law. The Constitution is clearly silent on the preborn. It is not remotely reasonable to infer from that that the Founders' intention was to give them the rights of citizenship.

The Constitution made no provision for the interstate highway system. Shall we tear it up?

It made no provision for federal revenue sharing of any sort.

It made no provision for a national federal pension (Social Security). Are you ready to run for office on a pledge to kill it?

There is nothing that allows the feds intercept and monitor this message when I hit submit. It does it anyway.

It requires search warrants to force local gov'ts to surrender information about me. The Patriot Act - which, of course, is not a Constitutional amendment - nullifies that.

It grants habeas corpus. What's going on in Gitmo?
