You are not following. The power was already there, in the states. In counting the shift a net gain to individual liberty, I am including the termination of chattel slavery; the end of Jim Crow, and promotion of universal suffrage, unencumbered by qualifications meant to maliciously discriminate; the incorporation doctrine, which made the states abide by the Bill of Rights; and other such measures. I agree that there should be a rebalancing in favor of the states, but that does not mean I would wish to go back to the pre- Civil War state of affairs........
