I've wondered the same thing. My guess is she is cutting a deal. That is the only explanation for the Wells Notice 30 day period coming and going in November. The strength in the stock seems to imply that a deal is in the works.

If she cuts a deal, I'm sure she would want to stay as CEO of her own company. Otherwise, no deal. That may be the sticking point. A fine is no big deal given her resources.

Three million shares are still short. Amazing.

One other thing about a settlement with the SEC. It will take an approval by the new Chairman. I haven't been following the problems with that agency and don't know where they are in replacing Harvey.

I bought some shares on the decline that occurred two days ago. The stock dropped about 10% on no news.

Two days later, we have news stories from the Wall Street Journal about how the US Attorney is stepping up pressure on the case.

Seem to me that somebody knew these articles were coming and leaked information that was traded on. I doubt that the SEC is concerned, however.
