It might not get far but that wouldn't prove anything about the question of whether or not he is a racist. It would only prove who won a particular political battle.

I got a feeling it will pass. Pickering could well have been part of the deal with Trent. Step aside garacefully, and GW will renominate Pickering. Both sides will want him. The rep. as a face saving deal to keep Lott happy, and some dems,. to use for the next election. Also, Pickering is not a USSC judge, and most of the lower judges don't recieve a lot of scrutiny.
