It is not necessary to discuss this topic at all if you can recall Chuck Schumer's statement at the end of the Pickering hearings. Schumer made it clear that it was TOTALLY about ideology. While he attempted to sanitize it in the media, if you saw his statement there was no doubt that Schumer intended to extend the notion of "advise and consent" to "unbridled veto power". This is wrong, and it is sheer joy watching Bush reverse a Borking.

He finds for the defendent who's a cross burner and you question where his head is at. By your standards, no one is ever a racist.
