He finds for the defendent who's a cross burner and you question where his head is at. By your standards, no one is ever a racist. So making sure a defendent gets a fair trial is racist? By your standards the ACLU is a racist organization. I don't think you even bothered to read the article for which I provided a link. The defendent got a fair trial; however, Pickering felt that the sentence the defendent got was unfair 'cause the other defendents, who already had pleaded guilty and were his co-conspirators in the crime, got lighter sentences. So that we're clear about this.....there was no question that the defendent got a fair trial and that the defendent was guilty. The issue was the sentencing. Judge Pickering on his own bequest filed a motion for a new trial. His action was not typical. Usually, the defendent's attorney files a request for a new trial. When asked, the Judge denied doing it; then said he didn't remember. I know that even with this new evidence, you will find a way to make Pickering into an ACLU saint. But for the rest of us who are not so biased, his behavior was highly suspicious and suggests his sympathies lied with the racist cross burner. That was in 1994, thirty years after Pickering had bolted the Dem. party because he felt the party was too preoccupied with getting civil rights legislation passed. Most of us who are not naive would determine that Pickering is a racist and find it very disturbing that there is a powerful element within the GOP that has successfully gotten him renominated for a second time. And they did that after the GOP got control of both houses. I can't wait to see what else this group has planned. ted
