The issue does not even arise unless the person is caught apparently fighting with hostile forces. If you are going to distrust the Administration this much, well, it doesn't need such a pretext, but can "disappear" anyone it wants, anyway, without asking permission or regulating the matter. I think one has to assume good faith, and that only those who have been captured in such circumstances are covered. Unless you, or most other citizens, intend to be sitting with the enemy on the other side of a ridge, without press identification or the insignia of an international aid organization, I do not quite see the slippery slope........
